Discretionary Trust

Assets you may currently control in a family discretionary trust do not form part of your estate. Generally speaking, the trustee of the trust (or directors of the company which is the trustee of the trust) can decide who will receive income or capital from that trust.

If you have a discretionary trust, an important part of the estate plan is to ensure that control of that trust goes to the person or persons you want to have the power to decide who will receive income or capital from the trust after you die or lose capacity.
